           The Supreme Court ruled March 8, 2022 that the jury’s verdict of $73,350 against the Okay Public Works Authority (OPWA) will stand effective and the landowner will be compensated.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Ritchie Rock &amp;amp; Atwood represented River Valley Mobile Home Community in this suit against the OPWA for the commission of an inverse condemnation taking and damaging of property. The OPWA alleged that it had the legal right, and was doing the landowner a favor by unilaterally moving into the small family owned mobile home park business and digging up their water and sewer lines and replacing them as part of a larger community water and sewer project. Problem was, that the OPWA and its contractor failed to get any easements to do the project, refused to stop digging when requested to do so by the owners, and did not properly perform the work which resulted in sewer lines being improperly installed such that it caused sewage backups in the homes. A classic case of “Big Brother”, the government, lacking regard for private property rights of the citizens.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           At trial, after Ritchie Rock &amp;amp; Atwood, filed suit on behalf of the landowner the government tried a very unique argument. The government argued that it could not be sued for inverse condemnation because the OPWA, a public trust, lacked the statutory authority to taken the property by the power of eminent domain. The government argued that if it didn’t have the power to take property, then it could not be sued for taking property by inverse condemnation. It argued that it had the power to condemn property for water lines but not for sewer lines. After the jury found against OPWA, the OPWA appealed the case. The appeal was assigned to the Court of Civil Appeals and the COCA ruled in favor of the government. Ritchie Rock &amp;amp; Atwood applied for a review of the COCA decision by the Oklahoma Supreme Court. Ritchie Rock &amp;amp; Atwood argued on appeal that such a reading of the law created a situation in which the toilet could be filled but could not be flushed and was absolutely an incorrect and strained reading of the law. The Supreme Court agreed with Ritchie, Rock &amp;amp; Atwood, reversed the decision of the Civil Court of Appeals and upheld the landowner’s judgment against the government.

      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;

            held the first public meeting on the new turnpike proposed by the Oklahoma Turnpike Authority. Several impacted property owners asked our firm to attend the meeting. Over 500 people assembled to learn more about the proposed turnpikes and have their questions answered by the representatives from Poe &amp;amp; Associates, who is the Project Manager. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;

            Generally speaking, a person should

            to their present deed. If you add someone to your deed and that person goes through a divorce or gets a judgment granted against them, it could result in the loss of that property. A Transfer On Death Deed does not create this problem. Grantee’s creditors and others, such as ex-spouses, cannot claim the property while the current property owner is still alive.

          On Thursday, the Oklahoma Court of Criminal Appeals ruled that the U.S. Supreme Court's decision (McGirt) was not retroactive. Therefore, past final convictions of Native Americans on Indian reservations are valid. The court said "new rules of criminal procedure generally apply to cases pending on direct appeal when the rule is announced, with no exception for cases where the rule is a clear break with past law”.

                    In the case, a Mother gave birth to a stillborn son. The decomposing deceased infant was found inside a wooden box that had been placed in a construction dumpster. The medical examiner determined the infant’s manner of death was homicide from methamphetamine toxicity while in the womb.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    The State alleged that the Mother neglected her unborn child by using illegal drugs while the unborn child was under the age of 18.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    The Mother argued that the fetus is not defined as a child under the age of 18 because a fetus is not a child until separated from mother at birth.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    The Court reviewed another 1994 case that held a viable human fetus is nothing less than human life. The 1994 case determined an unborn fetus that was viable at the time of injury is a ‘human being’ which may be the subject of a homicide if killed.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    Applying the same analysis, the Court ruled that “A child several weeks away from birth … is every bit as vulnerable to and in need of protection from neglect and its potential harm as a child one minute after birth.” “Oklahoma law … is to protect children, born and unborn, from potential harm because they cannot protect themselves.”

                    On July 9th 2020 the United States Supreme Court ruled in a 5-4 decision that Oklahoma did not have jurisdiction to prosecute major crimes involving a Native American within the historical boundaries of the Creek Indian reservation in eastern Oklahoma because Congress failed to formally undo the Muscogee (Creek) Nation’s 19th century reservation.

                    The question before the high court involved a case brought by Jimcy McGirt, a

    &lt;b&gt;&#xD;
      
                      
    
    
      member of the Seminole Nation
    
  
  
                    &#xD;
    &lt;/b&gt;&#xD;
    
                    
  
  
    , who argued that his case must be tried by the federal government because the crimes were committed on land historically allocated to the Muscogee (Creek) Nation.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    Today’s ruling most likely is one of the most consequential legal victories for Native Americans in decades. It could have far-reaching implications for the almost two million people who live across what is now deemed Native American territory by the Supreme Court. Because under the law, crimes involving Native Americans on a reservation are under federal, not state, jurisdiction.

                    According to the OSDH there are currently 27,147 confirmed positive cases of COVID-19 in Oklahoma of which 192 are registered in Mayes County. A total of five Coronavirus-related deaths were reported in Mayes County.

                    There are 24,140 confirmed positive cases of COVID-19 in Oklahoma, of which 153 are located in Mayes County. A total of five Coronavirus-deaths were reported in Mayes County until today.

     on July 9. This 4-color, county-by-county alert system was built using the White House’s methodology model for new cases per 100,000 population, and it adds an additional color criteria with the “orange” risk category. With OSDH’s alert system, in order for a county to be elevated to the “red risk” category, one of four additional gates must be met that would indicate emerging challenges in the delivery of healthcare services.

                    The Oklahoma Court recently held that a business negligently entrusting an employee with a vehicle can be held liable for a separate and distinct claim from the respondent superior doctrine if the employee is involved in a crash.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    The Oklahoma Supreme Court issued an Opinion on September 18, 2018 in Fox v. Mize that an employer’s liability for negligently entrusting a vehicle to an unfit employee is a separate and distinct theory of liability from that of an employer’s liability under the respondeat superior doctrine. Even an employer’s stipulation that an accident occurred during the course and scope of employment does not bar a separate negligent entrustment claim.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    What is the respondeat superior doctrine (also called vicarious liability)?  The term Respondeat Superior is Latin that translates to “Let the Master Speak for Himself”.  This law requires an employer to be liable for the acts of an employee if the act was conducted within the scope of their employment.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    This case arose when a truck driver was in an accident that killed a motorcyclist while the truck driver was driving for his employer.  The administrator of the deceased estate brought a lawsuit for negligence against the truck driver and against the employer under the respondeat superior theory.  The administrator also sued the employer for negligent entrustment of allowing the driver to drive the businesses vehicle.

  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    The court held that this was proper because the negligence claim under the respondeat superior theory was for a separate and distinct act than the act of negligently entrusting the driver to drive the business vehicle.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    How can this affect a business? The Court stated, “Employers employing unfit and unqualified drivers cannot insulate themselves from a negligent entrustment claim simply by stipulating that the employee driver was acting in the course and scope of employment.”

If you own a business, you need to make sure you have a procedure and are following it when entrusting any of your employees with a vehicle (or other action for that matter).  If you follow a proper established procedure to ensure that your employees are properly trained and prepared for the tasks you give them, you will be better prepared to defend a similar claim if one arises against your business.

                    An Oklahoma man was charged with thirteen counts of cruelty to animals.  The man argued that the maltreatment of his dogs all happened at this same time and location so it should be just one count instead of thirteen.  After reviewing the case, Oklahoma’s Highest Court disagreed with the man and held that he could be charged with all thirteen counts.  The Court noted that the dogs were separately chained or in separate pins.  The Court then looked at the statute regarding Cruelty to Animals and determined that the intent of the statute was to protect the maltreatment of any particular animal.  The man is now facing all thirteen Counts in Grant County.

                    The opinion was issued after a man near Elk City who was intoxicated from drinking throughout an entire day stopped at a convenience store to buy more beer around 9:00 pm before heading to a party.

&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    After leaving the party around 11:00 pm, the man crashed his vehicle into a three-car vehicle killing one and injuring two others in it.  After police arrived on the scene, the man was measured to have a blood alcohol content of .29g%.  That is over three-and-a-half times the legal limit.

&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    The Court held that the gas station had a duty to not sell the man extra beer knowing he was already intoxicated and can be held liable for the death and injuries of the car the man crashed into if a jury finds the gas station violated its duty.

                    Mary Fallin stated, “This is great news for Oklahomans, and means there will be no restrictions on individuals using Oklahoma licenses to fly or access federal buildings through October 10 of next year … I applaud our lawmakers for working in a constructive, bipartisan fashion in approving legislation earlier this year that made Oklahoma compliant with the REAL ID Act.”

                    DPS Commissioner Michael  C. Thompson said, “There have been many questions recently about Oklahoma’s status regarding REAL ID. We strongly appreciate Governor Fallin’s leadership in signing REAL ID into law.”

Governor Mary Fallin received and accepted a letter from Oklahoma Supreme Court Justice Joseph Watt stating his intention to retire at the end of this year.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    Watt, justice for the 9th Supreme Court Judicial District, wrote that his retirement will take effect Dec. 31.

    &lt;br/&gt;&#xD;

    &lt;br/&gt;&#xD;
    
                    
  
  
    
Watt, of Altus, began his judicial service in 1985, when he was appointed special district judge for Jackson County. He was elected associated district judge for Jackson County in 1986.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    In 1991, then-Gov. David Walters named Watt as his general counsel. He was appointed by Walters to the Oklahoma Supreme Court on May 17, 1992, and is in his 26th year of service on the high court. He served two terms as chief justice, from 2003 until 2007.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    “Having spent almost half of my entire life serving in the judicial branch of government, the past 25½ years on the Supreme Court have been the most rewarding of my entire life,” Watt said. “As the new year dawns, I look forward to beginning the next chapter in my life spending more quality time with my grandchildren, traveling with my wife, Cathy, and taking active retired status beginning Jan. 1, 2018.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    Supreme Court justices serve on the court as long as they are able and must appear on the ballot and be retained by voters every six years, according to state statute.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    “Justice Watt has served the state well while being on the bench for more than 30 years, including the past 25 years as a Supreme Court justice,” said Fallin. “He’s been a man of integrity, and has served with distinction. I appreciate his knowledge, dedication, and fairness while on the high court. I wish him the best in his retirement and want to thank his wife and family, too, for their sacrifice and service to our state.”

  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;

  &lt;p&gt;&#xD;
    
                    Watt earned a bachelor’s degree in history/government from Texas Tech University and a doctor of jurisprudence from the University of Texas Law School. In 1973, he moved to Altus, where he worked in private law practice and served as Altus city prosecutor until 1985.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    The Judicial Nominating Commission will accept applications for nominees to the court. The commission reviews the applications and submits three nominees to the governor.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    At the time of appointment, applicants must be 30 or older, have been a qualified elector in the 9th Supreme Court Judicial District for at least one year immediately prior to the date of appointment, and have been a licensed practicing attorney or judge of a court of record, or both, in Oklahoma for five years preceding the appointment.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    The 9th Judicial District consists of Harmon, Greer, Kiowa, Caddo, Canadian, Comanche, Jackson, Tillman and Cotton counties.

                    The Oklahoma Supreme Court voted unanimously that a worker who had two hernias at the same time (formally called bilateral inguinal hernias) was entitled to twice the amount of workers compensation.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    Under the Workers Compensation statutes, a worker who is diagnosed with a hernia on one side is entitled to temporary total disability for six weeks.  However, the Supreme Court ruled that under the wording of the statute, the six weeks applies to each hernia.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    In order to demonstrate the hernia was a compensable injury under Workers’ Compensation, the employee had to show that:
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    Once the employee showed that his hernia was a compensable injury, he was entitled to receive double the compensation under the statute since his hernia was bilateral.

  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;

                    The Oklahoma Court of Appeals recently ruled that the right to claim a child as a dependent for tax purposes is related to an award of child support, not part of property division in a divorce.  The Court cites several cases from other states as supporting the decision.  The Court further stated that since the right to claim the parties’ children as dependents is modifiable, it implies such rights are akin to child support.

&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    What does this mean for divorced parents? Anytime a modification is properly filed to change the amount of child support, it is also opening the door for a change as to which parent may claim the child or children on their taxes.  To help avoid this issue, it is important to address which parent is going to be able to claim the children on their taxes and on which years they will be able to claim them. If this issue is properly addressed in the original decree, it will help avoid issues regarding taxes down the road.

                    A new Oklahoma law is set to become active on November 1, 2017.  The new law allows for DUI suspects to have the option to have an ignition interlock device put into their vehicles and take a DUI prevention course or await the outcomes of their criminal cases to determine whether their license revocations are upheld.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    It will also become illegal for drunk driving suspects to refuse to take a breath test in Oklahoma.  The new law also will abolish the civil administrative process that suspects currently use to challenge the revocation of their driver’s licenses.

                    Common-law marriage is when two people are considered married without ever applying for a marriage license.  Oklahoma recognizes common law marriage.  Common-law marriage usually becomes an issue if a couple that has lived together for a long period of time breaks up or when one of them dies and the surviving party wants to inherit the deceased’s belongings through probate.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    Common-law marriage occurs when the parties agree that they married. A common law marriage is formed when ‘the minds of the parties meet in consent at the same time.’  Oklahoma Courts will consider and weigh the following factors to indicate whether or not a common law marriage has formed:
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    Oklahoma Courts have stated, “Often the most persuasive evidence of the existence of a common-law marriage is whether the couple listed each other as a “spouse” on legal documents.”  In probate issues, Oklahoma Court’s have looked primarily at the documentary evidence is written or signed by the deceased to determine whether a common-law marriage existed and the date was marriage was entered.

  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    In order to establish common law marriage, the party claiming that a marriage existed must be proved the marriage by clear and convincing evidence.
